Terms of Service
Last updated: October 19, 2026
These Terms of Service (“Terms”) are an agreement between you and GigVite Inc. (“GigVite”) and govern your use of GigVite — the mobile app, gigvite.com, and related services (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
1. What GigVite is (and isn’t)
GigVite is a platform that helps musicians, bandleaders, venues, and booking groups find each other, book gigs, staff lineups, sign agreements, and settle payment. GigVite is not a party to the bookings made through it: when a venue hires a band or a bandleader hires a player, that agreement is between those users. GigVite is not an employer, booking agent, talent agency, or manager, and does not guarantee any gig, performance, or payment between users.
2. Accounts
- You sign in with your phone number and a one-time code. You are responsible for keeping your phone number secure and for activity under your account.
- You must provide accurate information and be at least 13 to use the Service. Features that move money (getting paid, paying others, subscriptions) require that you are old enough to form a binding contract where you live and complete Stripe’s onboarding.
- You may delete your account at any time in the app.
3. Text messages (SMS)
GigVite text messages are transactional messages about your account and the gigs you take part in: one-time sign-in codes, gig invitations, contract signing links and signed copies, and replies to song requests. You opt in by entering your mobile number in the app or on gigvite.com; consent to receive texts is not a condition of any purchase. We do not send marketing texts without your separate consent.
- Message frequency varies with your activity.
- Message and data rates may apply.
- Reply STOP to opt out of text messages at any time; you will receive one confirmation message. Opting out of sign-in codes means you cannot sign in by phone.
- Reply HELP for help, or email info@gigvite.com.
- Carriers are not liable for delayed or undelivered messages.
See our Privacy Policy for how we handle your phone number. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
4. Payments
- Payments on GigVite are processed by Stripe. Musicians who receive money connect a Stripe Express account and agree to Stripe’s Connected Account Agreement. GigVite never holds your bank or card numbers.
- When a venue or payer settles a gig through GigVite, the payer may be charged a processing fee in addition to the amount owed, shown before they confirm. Splits to band members are free: musicians receive their full cut.
- Money is paid out only after the underlying payment settles. Bank (ACH) payments typically take several business days to clear. If a payment is later reversed, disputed, or returned, we may reverse the related transfers, and amounts already paid out may be debited from the recipient’s connected account.
- You are responsible for your own taxes. Where required, Stripe issues tax forms (such as 1099s) for payments you receive through the Service.
- Recording payments made outside GigVite (cash or check marked as paid) is bookkeeping only; GigVite has no involvement in those payments.
5. Subscriptions (GigVite Pro)
- GigVite Pro is an optional paid subscription purchased on our website and billed by Stripe. Trials convert to a paid subscription at the end of the trial period unless you cancel first; one trial per account.
- Subscriptions renew automatically until canceled. You can cancel anytime from the billing page in the app’s web payments section; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
- Prices may change with advance notice; changes apply from your next renewal.
6. Electronic signatures and records
GigVite lets users send and sign booking agreements electronically. By using these features you consent to transact electronically: your typed or drawn signature on a GigVite contract is intended as, and has the effect of, a handwritten signature, and electronic records satisfy any requirement for a writing. You may obtain a copy of any agreement you signed from its signing link, and you may withdraw consent for future electronic signing by not using the feature. The content of any agreement is between its parties; GigVite does not review or enforce user contracts.
7. Your content
You own what you upload (photos, recordings, bios, press kits). You grant GigVite a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as needed to run the Service — for example, showing your press kit on your public page. You are responsible for having the rights to what you upload, including music rights. We may remove content that violates these Terms or the law.
8. Acceptable use
You agree not to:
- break the law, infringe others’ rights, or misrepresent who you are;
- harass other users, or post abusive, hateful, or sexually exploitative content;
- use the Service to send spam, scrape data, probe or overload our systems, or bypass security and rate limits;
- circumvent GigVite’s payment flows to avoid fees owed on payments arranged through the Service;
- use another person’s account or phone number without authorization.
You can report content or block users in the app. We may suspend or terminate accounts that violate these Terms.
9. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. GigVite does not vet users, venues, or gigs, and is not responsible for the conduct of any user, the quality or safety of any gig, or any user’s failure to pay or perform.
10. Limitation of liability
To the fullest extent permitted by law, GigVite and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of $100 or the fees you paid GigVite in the twelve months before the claim.
11. Indemnity
You will indemnify and hold GigVite harmless from claims arising out of your content, your gigs and agreements with other users, or your violation of these Terms or the law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Louisiana, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes we will post the new version here, update the date above, and notify you in the app. Continuing to use the Service after changes take effect means you accept them.
